Prosecutors Terminate Case Against Salem Man in Fatal Pedestrian Incident

The Essex District Attorney’s Office has terminated the case against Francisco Garcia, 25, of Salem, who was charged with Accessory After the Fact to Leaving the Scene After Death.   A Nolle Prosequi, which withdraws the prosecution of the case, was filed yesterday afternoon in Salem District Court.

After a thorough review of all of the evidence in the case by the Salem Police Department and the Essex District Attorney’s Office, a determination was made that the evidence will not permit the Commonwealth to meet its burden of proof beyond a reasonable doubt at trial.

The fatality of the pedestrian, Phillip Grieves, 42, remains under investigation.
